La decisión de elaborar un instrumento jurídicamente vinculante a nivel mundial sobre el mercurio fue tomada por el Consejo de Administración del PNUMA en febrero de 2009. Los detalles del mandato figuran en la parte III de la Decisión 25/5.
El Consejo de Administración ratificó el mandato en febrero de 2011, a través de su Decisión 26/3.
Las decisiones anteriores del Consejo de Administración allanaron el camino para iniciar el proceso de negociaciones, concretamente la Decisión 24/3 IV en febrero de 2007 y la Decisión 23/9 IV en febrero de 2005.
